TERMS AND CONDITIONS OF PURCHASE

 

The rules of buying/selling products at the online shop

Right after receiving the payment, a package will be prepared and shipped, and the approximate date of receiving the package will be calculated.

Don’t forget to leave your email to receive information about placing, approving, and shipping the order. Please be sure to provide the correct phone number.

  1. General conditions.

1.1. These rules (Rules) of buying/selling products are a mandatory legal document for both Parties, regulating the rights of the Buyer and Seller, also the obligations, responsibilities, security, and the procedure of buying products at the online shop.

1.2. The Seller has the right to modify the rules at any point, following the requirements in the relevant legal documents. The Buyer is informed about the modifications on the website of the online shop. The Buyer obeys the Rules that are valid during the whole period of purchasing the products.

1.3. Individuals (and legal persons) mentioned below are eligible to purchase items at the online shop:

1.3.1. adults who are not restrained in any way to purchase such items by any court orders;

1.3.2. teenagers from 14 to 18 years who have the permission of their parents or guardians, except for the cases where teenagers are eligible to use their own income;

1.3.3. legal persons;

1.3.4. authorised representatives of all of the above.

1.4. By approving the Rules, the Seller guarantees that clause 1.3. makes sure the Buyer has the right to purchase products at the online shop.

1.5. The Agreement between the Buyer and Seller is considered valid from the moment the Buyer clicks the button “Confirm order” (see item 5) after he finishes choosing the items for the shopping cart, provides his shipping address, selects a payment method, and studies the Rules of the Seller.

1.6. Every agreement between a Buyer and Seller is kept at the online shop.

 

2. Protection and handling of personal data.

2.1. The Buyer has to study the Privacy Policy, which was approved and published by the Seller: https://shop.kaunasgallery.lt/en/privacy-policy/

 

3. Rights and obligations of the Buyer.

3.1. The Buyer has the right to purchase products at the online shop following these Rules and the rules in any information outlets of this online shop.

3.2. The Buyer has the right to decline the Sale and Purchase Agreement with the online shop, informing the Seller about it in writing (via email, specifying the product and order number) no later than 14 days after the product is delivered, except for the cases where the agreement can’t be declined due to any laws of the Republic of Lithuania (for instance, any specific agreements relating to books).

3.3. The Buyer can only exercise the right specified in clause 3.2. if the product has a factory defect – damaged inner pages, missing pages, or printing defects on the cover.

3.4. The Buyer has to accept the ordered products and pay the agreed upon price for them.

3.5. If any of the data about the Buyer has changed, the Buyer has to update the information immediately.

3.6. The Buyer agrees not to share the login data with third parties. If the Buyer loses his login privileges, he has to inform the Seller about it immediately through the means of contact specified on the Seller’s website.

3.7. The Buyer agrees with these Rules of sale and purchase and commits to follow them while also obeying any relevant laws of the Republic of Lithuania.

 

4. Rights and obligations of the Seller.

4.1. The Seller agrees to create all the conditions for the Buyer to properly use the online shop.

4.2. If the Buyer tries to harm the procedures of the Seller’s online shop in any way or violates his obligations, the Seller has the right to immediately limit the Buyer’s use of the online shop or stop it entirely, even cancel the Buyer’s registration in some cases.

4.4. The Seller agrees to deliver the Buyer’s products to the specified address, using a shipping method that the Buyer has chosen.

 

5. Ordering, prices, payment, terms.

5.1. The Buyer can purchase products at the online shop 24/7.

5.2. The Agreement is valid from the moment the Buyer clicks the button “Confirm order”, and the Seller approves the order by sending an email to the inbox specified by the Buyer.

5.3. The prices in the online shop’s final order are specified in euros, with added VAT.

5.4. The Buyer pays for the products using one of these methods:

5.4.2 via the PAYSERA system. The client has the right to pay using credit cards of Lithuanian banks.

5.4.3 via the PAYPAL system.

5.5. The Buyer agrees to pay for the products immediately, since the shipping package will be prepared only after receiving the payment.

5.6. Orders that are not paid for longer than two weeks will be cancelled.

 

6. Delivering the products.

6.1. The Buyer has to specify the exact shipping address after choosing the method of shipping. If a Buyer makes a mistake when specifying the address, he has to cover any additional expenses related to it.

6.2. The Buyer agrees to receive the products himself. In the case of the Buyer being not able to receive the shipment, the Buyer has no right to blame the Seller of giving the order to the wrong recipient.

6.3. The products are delivered by a courier authorised by the Seller, or the products are sent to a post office that’s closest to the Buyer.

6.4. The Seller delivers the order to the Buyer following the terms of shipping products. These terms are preliminary, and they don’t apply in the case of the Seller’s warehouse running out of the relevant products – the Buyer will then be informed about the issue. The Buyer also agrees that the package could be late due to any unexpected circumstances that the Seller is not responsible for. In such cases, the Seller agrees to contact the Buyer immediately and agree upon new delivery options.

6.5. The Seller is not responsible for any violations of the rules of getting the products to the Buyer if the products are not delivered properly due to any mistakes made by the Buyer or due to unexpected circumstances that the Seller can’t be responsible for.

6.6. The Buyer must inform the Seller immediately whenever the products are delivered in a damaged package, or whenever the wrong products (or the wrong number of the products) are delivered to the Buyer.

6.7. The Buyer has to write down his notes about any damage to the package in the courier’s (or post office worker’s) delivery document, or to write a separate document about the issue. The Buyer has to do this in front of the courier (or post office worker). If this is not done, the Seller can’t be held responsible for any damage to the package.

6.8. Clients can use one of the shipping methods mentioned below:

6.8.1. Delivery by post.

The products are delivered to a national post office that’s closest to the Buyer in Lithuania or abroad.

Every order is treated with urgency.

Typically, the delivery time is 3–5 working days.

Clients should be sure to specify the right delivery address and contact phone number (which is necessary in all cases), otherwise the package will not reach you, and sending it again will be an additional expense.

The price of using the post office for Lithuanian addresses is fixed – €3

The price of using the post office for European addresses is fixed – €10

The price of using the post office for other countries is fixed – €14

6.8.2. Taking your products from the Kaunas Photography Gallery is free.

You’ll be informed when your order is ready, and you can take your products from the Kaunas Photography Gallery:

Vilniaus g. 2, Kaunas, LT-44280.

Working hours: II–V 11am–6pm, VI–VII 11am–5pm.

Please take your order during a period of five days.

 

7. Quality of the products.

7.1. The specifications of every product sold at the online shop can be found in the description of that product.

7.2. The Seller is not responsible for any discrepancies that are a result of the screen the Buyer is using when shopping online – expected or imagined colours, sizes, shapes, etc.

 

8. Return and replacement of products.

8.1. Poor-quality or damaged products sold to the Buyer can be replaced or returned following the Rules of Return and Exchange of Goods approved by Order No. 217 of 29/06/2001 by the Minister of Economy, except for those cases where the agreement can’t be terminated due to relevant laws of the Republic of Lithuania (for instance, when the specific agreement relates to selling printed books). In any case, the refund money has to be transferred to the account of the Buyer.

8.2. If the Buyer wishes to return products following clause 8.1. of the Rules, he can do so in no later than 14 days from the actual delivery date, informing the Seller through the means specified in the “Contacts” section of the website, specifying the name of the relevant product, order number, and reasons for the return.

8.3. The Buyer has to obey the following rules when returning the products:

8.3.1. the product being returned has to be unused and in mint condition;

8.3.2. the product can’t be damaged by the Buyer;

8.3.3. the Buyer has to have a buying document of the product upon returning it.

8.4. If the Buyer doesn’t obey the rules in clause 8.3., the Seller has the right to decline the return request by the Buyer.

8.5. If the Buyer was delivered the wrong product or a poor-quality product, the Seller agrees to replace such products with proper ones.

8.6. In the case of the Seller running out of relevant products, the Buyer gets his money back.

 

9. Responsibilities of the Buyer and Seller.

9.1. The Buyer is entirely responsible for the correctness of the data he provides. If the Buyer leaves incorrect data within the registration form, the Seller can’t be held responsible for any consequences due to it and therefore has the right to demand a compensation from the Buyer for any additional direct expenses.

9.2. The Buyer is responsible for his actions while using this online shop.

9.3. Upon registering, the Buyer becomes responsible for sharing or not sharing his personal data with third parties. If a third person is logged in using the login information of the Buyer, the Seller treats this person as the Buyer.

9.4. The Seller is released from any responsibilities in the cases of any additional expenses being a direct consequence of the Buyer not familiarising himself enough with these Rules, even though he had the chance to do so.

9.5. If the Seller’s online shop has links to the websites of other companies, organisations, institutions, or individuals, the Seller is not responsible for any activities on those websites. The Seller is not a representative of those companies and he doesn’t control their actions in any way.

9.6. In the case of financial loss, the Party at fault covers direct expenses to the other Party.

 

10. Marketing and information.

10.1. The Seller can initiate various sales and similar activities for his online shop.

10.2. The Seller has the right to change or annul the conditions of such sales and similar activities without informing anyone separately about it. Any change or modification of sales or similar activities is valid from the moment of changing them.

10.3. The Seller sends all messages to the Buyer via the means of contact that the Buyer has specified in the registration form.

10.4. The Buyer sends all messages and requests to the Seller via the means of contact specified in the “Contacts” section of the online shop.

10.5. The Seller is not responsible for the Buyer not receiving any messages due to Internet shutdowns, connection problems, or any other technological obstacles the Buyer might face.

 

11. Final conditions.

11.1. These Rules of sale and purchase were set up following the relevant laws and legislations of the Republic of Lithuania.

11.2. Any dispute arising out of these Rules, which can’t be amicably settled between the Parties, shall be referred to adjudication/arbitration in accordance with the laws of the Republic of Lithuania.
